Can I file a trademark application myself?

In most jurisdictions, citizens can file a trademark application directly with the IP office without legal representation. Non-citizens are typically required to appoint a local representative.

In the EU, non-EU/EEA applicants must have a representative. In the US, foreign-domiciled applicants are required to use a licensed US attorney. In some jurisdictions, self-filing is not permitted at all regardless of citizenship.

Even where self-filing is permitted, the IP offices generally advise having legal representation. Errors in the goods and services list, an insufficient response to an office action, or failure to identify a conflicting mark during the search are common causes of avoidable refusals.
