
When should I register my trademark?
Timing is everything, and this is especially true when it comes to trademark registration. Choosing to trademark your brand at the right time is much more important than you would think.
Not before registration. The EUIPO does not require evidence of commercial use at the filing or registration stage. An EU trademark can be filed before the brand has launched in the EU market.
After registration, genuine use in the EU within five years is required to maintain the registration. A trademark that remains unused for a continuous five-year period can be cancelled by a third party on non-use grounds.
