The initial filing fee is the same for both intent-to-use and use-in-commerce applications. The total cost of an intent-to-use application is higher overall because of the Statement of Use fee due later in the process.

When the USPTO issues a Notice of Allowance on an intent-to-use application, a Statement of Use must be filed to complete the registration. This carries an additional fee of $150 (Kč 3,800) per class. If extensions of time are needed before filing the Statement of Use, each extension request costs an additional $125 per class. A use-in-commerce application has no equivalent post-allowance fee.
