How does the trademark registration process work?

A trademark application is assessed by the IP office of the country where protection is sought. The process typically takes between 3 and 18 months depending on the jurisdiction and whether any complications arise.

The examiner first assesses whether the mark is distinctive and does not conflict with earlier registrations. If an issue is found, an office action is issued and the applicant can respond. Applications that pass examination are published for a set opposition period during which third parties can challenge the mark. If no successful opposition is raised, the trademark is registered and a certificate is issued.
