How much time do I have to respond to an office action?

Office action response deadlines vary depending on where your application was filed. The standard timeframes for most major jurisdictions are:

  • US: 3 months from the date of the office action, extendable to 6 months for a fee of $125 per class.
  • UK: 2 months, with a possible extension of up to 4 additional months.
  • EU: 2 months, with a possible extension of 2 additional months.
  • Australia: 15 months from the filing date of the application (not the date of the office action).
  • Canada: 2 months, with extensions available.

If you miss an office action deadline without responding or requesting an extension, your application will become abandoned. Extensions must be requested before the current deadline expires.
