If my trademark application gets dismissed, do I lose the fee?

Yes. Government fees paid to an IP office are non-refundable regardless of the outcome. If your application is refused, withdrawn, or abandoned, the fees are not returned.

The most effective way to avoid this outcome is to conduct a thorough trademark search before filing and to ensure the mark is sufficiently distinctive. A trademark attorney can assess the registrability of the mark, identify conflicting registrations, and draft the goods and services list correctly, all of which reduce the risk of a refused application.
