What is trademark monitoring?

Trademark monitoring is the ongoing practice of tracking trademark databases and other channels for new applications or uses that could infringe on an existing registered trademark.

Registration gives a trademark owner exclusive rights to use the mark in commerce, but it does not automatically alert the owner when someone else files a similar mark or starts using a confusingly similar brand. The owner must discover and act on infringement themselves. Monitoring is the process of doing that systematically, rather than relying on chance.

The most common focus is trademark registers: new applications for confusingly similar marks can be opposed during the opposition window, but only if the owner is aware of them in time. Monitoring services can also cover business registers, domain names, social media, and online marketplaces.
