Can I submit a packaging as a trademark specimen?

Yes. Product packaging is one of the most commonly accepted specimens for physical goods. To be accepted, the specimen must meet the following:

  • The mark must be prominently displayed on the packaging.
  • The mark shown must match the mark as originally filed.
  • The packaging must make clear what product is being sold under the mark; through a product description, an image of the product, or by clearly showing the product itself.
  • The specimen must be a real photograph of actual packaging, not a mockup or rendering.
