What happens if I don't submit the Statement of Use?

If you don’t submit the Statement of Use within the allowed window, or if you don’t file an extension request before the deadline, your trademark application will be considered abandoned. The filing and legal fees you have already expended will not be refunded.

After the USPTO issues the Notice of Allowance, you have six months to file the Statement of Use or request an extension. Extensions are available in six-month increments, up to a maximum of five extensions (36 months total from the Notice of Allowance date). Each extension request must be filed and paid for before the current deadline expires; a missed extension deadline results in abandonment.
