How much does it cost to submit a Declaration of Use?

The USPTO fee for filing the Year 5–6 Declaration of Use (Section 8 or Section 71) is $225 per class of goods and services, if filed before the grace period. Filing during the six-month grace period incurs an additional surcharge.

The Declaration of Use can also be filed together with a Declaration of Incontestability (Section 15), which costs an additional fee, bringing the combined total to $425 per class. If the Declaration of Use is filed at the 10-year renewal alongside the renewal application, the combined cost is $525 per class.

These are government fees paid directly to the USPTO. If you file through a representative, additional fees for their services will apply.
